LFS whants ornate back?

I run a store, and if one of my people made that mistake I would be highly upset. That is not your fault though, and the store is just going to have to eat the loss.
 
To bad for them. I would keep it. You asked the price, was told a price and paid for the fish. That transaction was done as soon as they gave you your change.
 
Nice to know there are Todds working at lfs's other places. I picked up a 7" clown knife the other day for $5 because the employee didn't have a clue what kind of fish it was, and it wasn't marked on the tank. I said thank you and now enjoy him everyday.
 
you don't have to return the fish. it's their mistake/loss. if they wouldn't do business with you anymore 'cos of that and you happen to see fish in their store that you wan't to buy badly, bring someone along, pretend that you do not know each other and make that friend buy the fish for you. simple as that.
 
Like I said before, negligence is no excuse. I am in a Business Law class right now, and I can tell you, that when they offered you a price and you accepted by paying and recieving the fish, you have encountered a legal contract for purchase. Just because one party was unaware of the actual price gives them no right to rescind the contract. They have NO legal right to ask for the fish back, nor do they have the right to refuse to sell you any more fish. If I were you, I would tell them you have a very good understandig how businesses and business contracts work, and if they want to continue to have their business lisence they need to treat you equally as everyone else after this incident.

Every lfs makes mistakes, this one just happened to catch it and attempt to call you out to make the employee look better. You know your moral and ethical standards, and they are most likely different than mine, but I would keep the fish and tell them to educate people more and prevent it from happening in the future.
 
wow dident relize so many people would reply so fast:) , i think iam going to just bring it back i like the fish but not that mutch(also its small and beeting up my senegals)plus i know there will be other fish there i whant(its also the only place to get blackworms)and even though i dont realy like most of the people that work there i would like to keep in good standings with them, it isent realy the best store but dos get in fish no other store dos(like the tiny dats people are seeing around for $30)i gess its one of those weigh the good with the bad things, the guy that sold me the fish was the one that asked for it back and i know hes been there for a long time but from what ive seen he dosent know mutch about fish, one thing i dont get is how he never noticed what kind of fish it was when he was netting it or bagging it so when did he know he sold me the wrong fish? and i know it seems like a long way to drive but lets just say my lasy few trips there dident cost me any gas money(that is if i drove:D )and my time is pretty worthless, and i gess sence i have been comeing there more frequenlty latly the guy thought it wouldent be that big of a deal.

Tough call. I'd still ask for the cost of gas (once again ignorance is bliss, that they don't know you aren't driving is their problem). To be nice, accept store credit for the fish and gas. :D
 
Keep it because it's legitly yours. It doesn't matter if he wants it back, it's his fault. He can't force you.
