maybe get someone trustworthy to house sit for your vacation? just to make sure this guy doesn't end up breaking / stealing stuff.
 
I believe you can't just kick him out or he can sue/press charges (which it looks like you already knew). What does the lease say you can do to him? Honestly, I would just go talk to some real legal counselor to get legit advice and see what actions are worth it and what are not.
 
Definitely speak to a solicitor and I would seriously consider cancelling your holiday if he is going to be alone for a week while mad at you in your home. Better to lose a holiday than to pay for damages he will cause when you are away.
Cant you get around cancelling your holiday by using the court case to get your holiday insurance to pay up?
 
Usually after you file for eviction, a sheriff will present him with a 7 days letter, giving him 7 days to pay, or vacate. They will also assign you a court date for both of you to appear, to determine if you will get any of the back rent/utilities owed. Be sure to take all utility statements and check stubs showing where you payed them all. Any and all paperwork you have will help you win. I went through this with a "friend" and it was a nightmare. No I am not canceling! This trip has been planed for a year, and Paid for.
I work for a University as a Network Systems Services tech and I have held down the work load for five guys for the past 2 months plus my own work which is outside in DE summer, not to mention students move back on campus this weekend and I will have two weeks straight on my time sheet.
Over worked under paid. It's time for a vacation. Worst case he will be on camera.
 
Have another buddy/family member come stay at your place while you're gone. If he starts trashing the place, have them call the cops.

You gotta get someone to watch that house while you are away.This punk sounds like the sort who might pull some type of retaliation.Any relatives available?
 
Been there and done that in PA. Thankfully I had saved text messages, emails, and gave receipts for all payments for my roomie. I was able to have a cut and dry court case where I recieved my money and then some for being late and causing me to scramble for bills. unfortunetly one can not garnish wages in PA so I only saw about 80% of it but most is better then none.

I had to take a 4 day trip out to Colorado for work and had my best friend and brother stay in my place while I was gone. This was I was sure someone was always there as my friend worked nights and my brother worked days. My roomie was unaware I had both in the house and knowing my brother worked during the day he tried to take video games, my PS3, and the TV from the living room. Little did he know my friend (a LARGE personal trainer) was in the bedroom and heard it all and was NOT pleased to be woken up. I wish I had had that on camera or my friend had simply called the cops so they could have witnessed it but I imagine being body slammed into the ground by a throat grab from my friend was more of a shock to the roomie...and I also wish I had that move on camera....
