This certainly appears to be an overreach. However, facts are always good. In the solicitation letter:

First:

"It [Monster Energey Company] also requires us to drop the trademark applications that were pending at the time for said trademarks."

Later:

"As you know, we have been using our MonsterFishKeepers and the MonsterFishKeepers “M” design marks since March 30, 2005 and the marks were duly registered with the U.S. Patent and Trademark Office since October 23, 2007."

What mark apps were pending?

I, too, am just finding out about this - Ridiculous! Without offending anybody, it's like North Korea rattling its saber just because they think they can get away with anything.

On another note - I fully support MFK, but am wondering why the M is still in the upper left corner, after a cease and desist has been issued? Does that mean "we" are breaking the law, by continuing to use it? Just curious, since I know nothing about these things.

the removal of the M is only a breaking of the law if we go to court and lose. Until that point we can spam the internet with that M as much as we want to.

It's the company that's whining, not the courts.
do you think if I called monster energy dinks and told them to cease and desist, they'd take down their m?
