Monster Energy Corporation vs. MonsterFishKeepers.com

  • We are currently upgrading MFK. thanks! -neo
If you know any people who have blogs, please get them to post about this as well. We will be more powerful if we do not come off like flaming a holes, so remember to clearly and concisely state the issues and your support.

The gumption of the desist letter is appalling. Seems like a low level attorney secretary sending out letters to every possible infringement, with no real legs to stand on, hoping some will stick. It's easy when you're a corporation to tell little organizations that they aren't allowed to wear brown shoes even though it would never hold up in court. The reality is who wants to find out.

The part where they want this site to pay for the legal fees to even send the letter seems like a scam that if even one target complies with is worth it for them. Disgusting.

Monster owns some other brands, notably 'PEACE TEA' drinks...(ironic)...which is a tough boycott but necessary. Any thoughts on starting a kickstarter for legal fees? Also, I thought that by registering a copyright only protects you within your industry...meaning if Monster Energy and Monster tea bags existed, that would be a legitimate concern...however Monster Energy and 'Monster Energy' (lets say they are a fake battery company) could exist due to being involved in unrelated industries. We run into this at my work, a large manufacturer, with dealers of our products bearing our names. I wish you luck, I'll sign the petition and ask for Monster to be removed from our vending machines (if there is any now) and ask for a company ban (230 + employees...all hardcore fishermen up here in NW PA, we go after 'dem muskies).

An example of a letter that could be sent to any bloggers/friends, etc is:
I know you have a huge email list, so I thought I'd hit you up to
share a link around that is very important to the online fish keeping
community right now.

You may or may not be familiar with the Monster Fish Keepers
Network... The MFK network is an incredible resource for aquarists
around the world. Thousands of beginners rely on information and
conversation on the MFK websites (aquariacentral.com
monsterfishkeepers.com aquatic-photography.com) as they learn how to
properly keep aquariums. The sites are a vibrant community maintained
by volunteers.

Monster Energy Drinks is threatening legal action against
MonsterFishKeepers.com for trademark infringement.
MonsterFishKeepers.com has had a registered trademark since 2005, but
this hasn't stopped Monster Energy Drinks from threatening action. The
logos are not similar, do not use the same color pallet, and the
brands do not compete for the same audience. Monster Energy Drinks
knows they have no legal standing, in fact they have dropped similar
suits in the past when public pressure was too much to bear. The
Consumerist ran an article about it this morning.

Boycott Monster Energy Drinks, especially in public parks and facilities.

Thank you,

and speaking of hash tags:
it's awesome to see how much public support we've gathered in just a couple of days of work. We put together a great team effort and it's going to pay off. With sources like the Consumerist covering the story, it should be no problem to keep the ball rolling and the signatures coming in. But there's one more thing we can do.

We need to start sending twitter messages to people who are sponsored by Monster Energy drinks. Guys like Ken Block, TJ Lavin, Rob Dyrdek, Chad Reed... EVEN SNOOP DOG! there is a complete list of athletes and celebrities on their website... http://www.monsterenergy.com/ca/en/athletes/

Send messages via twitter to these individuals, and ask them if they think it's cool that their sponsor is attacking aquarium geeks!
