Dear sir or madam,
I am deeply dismayed to learn that Monster Energy has issued a cease and desist order to Monster Aquaria Network, the operators of the Monster Fish Keepers website, over copyright infringement. The letter stated that both the word “Monster” and the “monster M” logo for the website, stop being used, despite the fact that the trademarks have been registered since 2005.
In that letter, it was stated that a hypothetical similarity between the Monster Energy and Monster Fish Keeper logos would confuse consumers -- ie, that the people who drink Monster Energy products are too stupid to tell the difference between the two! This asserts that consumers (a pejorative at this point!) are incapable of discerning the following elements of the Monster Fish Keepers logo that distinguish it from the Monster Energy logo:
- horn and tail spade embellishments and serifs extending from a smooth margin , as opposed to irregular edges tapering to points,
- a white letter on a navy blue field, as opposed to yellow-green or cyan on a black field,
- an outer glow layer style effect instead of bevel and emboss.
Continental Enterprises, the company contracted by Monster Energy, is causing more harm than good by sending out blanket cease and desist orders. By doing so, they have provoked portions of Monster Energy's consumer base to boycott! <<I previously enjoyed your Monster Energy Lo-Carb and Absolutely Zero products. Instead, I will resume drinking Venom Energy's Mojave Rattler, even though it is more difficult to find.>> I suggest that your company contract another intellectual property protection that will do a better job with the money with which they were paid.
