Need help what would you do?

I'm looking for suggestions. On Feb. 13 I paid $300 which included shipping for a fish from one of our reputable vendors here on MFK. The PM I sent him right before the payment was this: "If you can give me a total payment amount and your paypal info I'll get a payment out to you asap. The weather here is terrible this week, but looks better next week. Thanks." He gave me the amount and I sent a payment. He sent me an e-mail saying he shipped the fish out and it would be here tomorrow. I thought he would have checked to see if the weather was ok and if I was available . I was able to get off of work but there was a snow storm that day. I sat at home all day and called FedEx several times because they were late and was told that they were running late but it would be delivered. At 7:00 PM the web site said that it was undeliverable due to weather. I drove 80 miles round trip to the FedEx warehouse and banged on the door and got the package only to find the fish dead. I did all the stuff I was required to do and was told by the vendor that it could take 2 to 3 weeks for FedEx to process the claim. There has been correspondence between me and the vendor during the wait but now that we are going on over a month now I was wondering what he was going to do to resolve this. I sent him 2 e-mails earlier in the week and a pm and have gotten no reply. He has posted here during that time so I know he is available. Between the fish, missing work, and travel cost I'm out about $460. He has a great reputation which is why I'm not giving his name, but I don't know what else to do. What does everyone think? Thank you in advance for any input.
 
Depends on his policy. I would say you should get a credit from what you spent on the fish only. Shipping is usually not refundable by any vendor. The travel and work-loss was your decision, not his. Just my .02. Vendor should man up and give you a credit on your next order. Hope everything works out for you and I applaude you not giving any names out. We dont need to bash anyone....work it out with him. Theres got to be a happy medium.

have you contacted fed ex since the claim was put in?

I agree I'm just looking for the fish, I don't expect anything for my time just making the point that I think I did all I could and still have no fish or money. How long should I wait?
 
I have not. The shipper is the one required to file the claim as per FedEx policy. And I told him that I understand he is waiting on them. I'm trying to be patient but this has been going on for awhile. The main problem I have is the no response from him recently.

they thats bad on the part of the shipper, he should at least file the claim.....
 
I'm sorry if I was unclear the shipper did file the claim. It is just that it has been over a month and no results and now he has not responded to my emails recently.

yeah its not like your not making a profit on the deal, keep your good rep here anyway
 
I would like to thank everyone for there input and advice. I just heard from him. He said that FedEx denied the claim but he is trying to appeal it and asked that I be patient. So at this point I just keep waiting.
