Need help what would you do?

How did you pay for this? If the person accepted a credit card or paypal, contact them immediately and dispute the payment. Most credit cards will put a dispute, and if they may give you your money back, and some cards have a 'hidden' protection on items you purchase. Paypal will help you resolve the dispute.
 
Looks like people have given some good info for you here. Sounds like reputable guy. If anything FedEx sucks in my opinion, they are difficult to deal with a) their carriers are actually independant reps so if the driveway is too slippery they can pass and make up any excuse, b) tthey will probably deny any claim first time, but weather can be proven to be fatal. I would just put in another order for fish with same guy and worst case be out shipping money.

On another note, I think your absolutely NUTS for ordering fish this time of year!!! We have had 2 weeks of good weather in the north east, but today we got 4" of snow and its going to be in the 30's this weekend. If I'm dropping $300 on fish - there is NO WAY IN HELL I'm taking a chance. Again, that doesn't mean the cold by you killed the fish.

I did pay with paypal but will not dispute the payment. I don't feel the blame is only on the vendor, it's mostly fedex, and will not stiff him on the payment . He sent me another message that he will have a answer by the end of next week. If the claim gets denied again I'm sure we can work something out as long as there is good communication.

I agree fedex sucks. I was very hesitant to order this time of year, but there were so much positive feedback from people in cold places who all got there fish on good health that I did it. It was the cold that killed it the water was about 40 degrees when I got it. They rode around in the truck with it for 8 hours. And the box was clearly marked live fish keep warm. It was supposed to be delivered by 10:30 am at the latest. I picked it up from them at 7:45 otherwise they would have left it for the next day. The lady that gave it to me looked at the writing on the box and said you would think they would have delivered this one first.
