Its not illegal to to have live fish in your checked baggage, its just an airline policy that you cannot, a fairly new policy at that. It is however illegal to cram a mammal, bird, reptile or amphibian into your checked baggage.

He broke an airline rule, not a state or federal law.

I may have risked it with a more common fish, but not with that one!!

I may have to try this myself now, I have passed on a lot of fish because of FAA regulations....

I thought it was the FAA regs too.. google "tsa prohibited items"
