A good temp for P's is 77-82. Your tank would work for a few months at most, but will get cramped very quickly. A good gauge of space is 20g per fish. Your best bet is to have at least a 75g lined up to transfer them too. A 55g will cut it, but not comfortably for them.
Over filtration is recommended as P's are very messy fish. A lot of P owners have 10x the filtration of their tank. For example, if you have a 55g, you'll want to have filtration at 500-550gph. A lot of people run two filters on their tank, like one canister filter & one HOB filter.
RB's are a very nervous & skiddish fish. If you're looking for bloodthirsty killers, they are NOT your fish. They will freak out from time to time and love to hide. Depending on the individual fish, some may come out of their shells and get comfy, but others may forever be skiddish.
You might want to talk "quietly" if you are planning to own P's in an illegal state, it's not the best thing to advertise. The fines are pretty hefty if you are singled out.

A few words of advice from me to you.. If you plan on keeping piranha anyway, change your location.
Now to answer some of your questions, For your forty gallon tank I would recommend a single specimen tank. Meaning ONLY one fish. Most full grown piranha will only fit comfortably in a tank that size if kept alone. This will keep your fish in immaculate shape and health as you can see some of the pictures of our single specimens in the POTM contest. Most people will get into piranha for their reputation, but only a few select people stay with them. Piranha are some of the most interesting fish IMO so hopefully if you do get into them you will stay with them too. I wont list the types of piranha that you can acquire and keep but if you go to AQUASCAPEONLINE.COM and click on their piranha section im sure you will find something you like. I recommend that you get one that you will admire for its beauty and not the glass banging attitude that you hope it will have.. I keep my piranhas at 85 and the warmer it is the more active they will be.. if you have any questions send me a pm and ill answer all your questions..
