yes it is, we live in the houses and that's on our private land
He got stuck but he came out for air and when he did not there was a hole in the rock were he got air from but it's easy to catch him,al you do is move the rocks (I did this twice lol) 
You need to get him a better pond, the rocky environment there will cause abrasions and sores which could lead to nasty infections and shell rot. I would suggest keeping him inside until you have a better pond for him with several inches of sand at the bottom and no rocks for him to get stuck under and drown.
