you could put him in a 55gallon tank but a 75 gallon would be better
 
Nothing smaller than a 55 will suffice. But try to get atleast a 75 gallon aquarium for him so that he will atleast be able to comfortably turn around, because tanks such as 55's are only 12" wide and as i am sure you know oscars can easily reach lengths of up to 14". You wouldnt want to take your oscar out of an uncomfortable situation only to go and place him in another would you???
 
he's only gunna be in there for maybe a couple months and he's about 6 inch's so a 55 will work just fine for a lil wile untile i get them all a 125 or 150
 
i say that oscar is better in a 40 than back to a lfs which most dont care about the fish on the £££$$$ which i can understand. if hes in a 40 he shouldnt grow to 14inch more like 8-12", i say go for it......also i have a 35 with a width of 15". its 36by15by15
 
The standard 55 in 4ftx13"x20". Most oscars will grow 10" in ther firsy year of life. However only having your oscar in a 55 for perhaps 3-4 months will be ok.
