Somewhere I read an article where one of the ASPCA directors did not believe fish cruelty was really an issue. I do not remember where that article was published though.
Deciding whether a fish should be protected as are dogs or cats would be up to the State. New York law covers every living creature except a human being, while California law covers every dumb creature. In the Arizona Criminal Code, animal includes mammals, birds, reptiles and amphibians. In Alaska criminal law, animal means vertebrates, but not fish.
The law generally recognizes animals as property, for this reason they do not have individual rights. all 50 states have laws forbidding the intentional mistreatment of an animal, and unless things have changed since I last checked, 47 recognize some actions as felonies.
No one cares about fish though.
If most of the fish-keepers in the US were subjected to the laws of Germany regarding pet fish, we wouldn't see as many of these videos on youtube, or those tanks at wall mart. The chairman of the GLS and IRA had his opinion translated into law. You cant even keep a betta in anything under ten gallons in Germany.
