I plan on having a sump for my 40 gallon tank. The sump will be a spare 20 gallon tank. The overflow will go to the sump and then a xp3 filter will pump the water back into the main tank. Will this work or is this plan seriously flawwed?

I think your best bet would be to just get a pump for the sump.
Use the xp3 on another tank or sell it(to pay for the pump) if you really wanna go with a sump.
 
I'd agree.. you can get more than enough pump for 40.00(were talking for a 40g tank) or so and it will be simplified by selling/not buying the xp3 and going straight with a real water pump.
 
The major flaw with that idea, is that the XP3 will slow down with all the media getting clogged, that it will not operate at the show gph due to low flow into the canister, and depending on how high up the 20 gallon is, there probably won't be enough pressure to even start a siphon into the XP3. Canister filters are fed by gravity, and if they are not a below the water line, they will not operate at all.
