the damages are/will be awarded according to amount of money earned off of said usage. Being that it was just a Dj spinning the records at an event and later posted on a website for a couple of days the amount if any will be small. It's not like it is a sampling/clearance issue where there will be punitive damages and a percentage of all future earnings. Nice to see monster get a taste of their own Medicine but it's not a large enough dose to expect them to stop illing :)

I still think monster should get hit with the huge fines the record labels hit individuals with. In my eyes what monster did was no different then if I download a song without paying for it. Even if it was a DJ it is still not the property of monster. Hit them up for each download. :)
 
while Im biased with this, It's not the same. to put it in perspective. this can be compared to You uploading a video of Your tank on Youtube with Your favorite song playing in the background. Hardly copyfight infringement in my eyes. but the powers that be are trying to make it such. with that said I hope that monster is made an example of. I would love to see the Beasties stick it to the system, And I would enjoy seeing monster get popped. But the reality is this lawsuit will not weaken them, It will only add fuel to there burntout perception of what they think infringement is. Think about it... We are being sued over the letter M, and the word Monster... Correct me if I'm wrong. But I dont think monster even sponsers a pro fisherman.
