Selling laws?

Hi,

I was at my LPS and the guy who runs the fish department is friends with me. I was asking about catching some of our invasive plecos and bringing them in for him to sell. Any way I got to thinking for a second then asked "What about some of the native species? Sunfish and stuff?" He said I wasn't sure he could sell them, but that people were always asking if they had them available. I asked him to check on that and we would talk about it next time I came in.


So I figured I would ask on here if FSs can sell native species? I would think that it makes perfect sense that a FS could sell them, I mean if people bought natives rather than exotics we wouldn't have invasives.
 
That sort of thing is independently regulated by the states for the most part. I feel sure that it is legal to sell natives in FL, since Sach's Aquaculture, which sells many native fish, is located there; there is probably a permit required from the state DNR.
 
It varies state to state, but if you lfs sells mollies, then they can sell native fish. Around here, most lfs of any size sell gar, mollies, flagfish, dragon gobies, and occasionally others. So, yes, lfs can sell natives, but how those natives were obtained might be something entirely. Check the sticky above, about collecting, and laws state by state.
 
I think the DNR's tend to ignore the species you listed, as well as rosy reds and channel cats. It may not be a good indication that selling natives is legal.
 
Okay I've read very carefully over Florida laws on collecting fish. It will be easy to get the fish he wants.
 
Yeah, that's true. I was supposing, and that's why I directed the op to the sticky. Funny how an agency could decide what to enforce, and what not to, isn't it?

The store in question sell Florida Gars, I was sure it was legal now I'm positive.
 
yeah they are able to. i just called the FWC today about selling a Bowfin and all you need is a commercial fish selling liscence. And your LPS should have that so you should be good.
