Selling/trading natives?

Hi,


Is it illegal to sell or trade a native species that bred in your aquarium, pond, or a private pond? In other words, is the fish, frog, toad, etc your property?
 
Depends on the state. In Ohio you must have a permit to sell native species.
 
You know what there are a lot of native fishes being sold on Aquabid. I even saw some Largemouth Bass too.
 
Yes, Ohio requires an aquaculture permit to breed and sell natives. Also for certain species you will need special permission from the chief of division of wildlife.
 
Most of those guys probably have the permits too. Usually you can trade natives without a problem but again it really depends on the state.

I have called the Pennsylvania Fish and Boat Commission on this topic about 5 times and never got a call back. I have emailed several different times and didn't get a response. I am getting extremely frustrated. I don't want to sell either.. just trade.
 
Well I am not trying to make a business of it. Just wanna sell a few things. I also was planning on buying some natives from a licensed dealer. And when those breed was planning on selling the babies. But I am a little apprehensive cause I'd like to know I am in the clear. I don't wanna advertise and have someone set up a sting on me and show up at my door giving me fines etc.

I was told by this licensed dealer that breeding my own natives and selling should not be illegal.

I am not sure of the legalities, so I can't comment there, but I find it highly unlikely you are going to get caught in a sting if you throw a few fish up on Aquabid, provided they are not endangered. I just don't think the resources are available to bust someone for selling a few Bluegills. Now, if we are talking a large scale operation you garner some attention, but otherwise, I would not worry.
 
I got caught wanting to trade natives. Didn't get into trouble, because I didn't actually do it, but in VA you cannot import or export any wild animal.
