Call your local BBB and file a complaint with them. It will give you a chance to post a complaint to warn other people about his lousy practise and often time venders will refund money to make the problem go away. The bbb will contact this person and be a thorn in his side for a while untill it is resolved or thay will post on thier sight that it was unresolved and basically make him look bad.

My policy when putting my fish in a LFS to sell is that if they die, I tell the owner to freeze it for me. Usually they have a freezer in the store and shouldn't have a problem doing so.
