There is no federal ban on wels. State-by-state - one must research.
The only source of wels I've found ever in the US is through Wes (Rare Fish), CA. Just very recently he's sold at least a dozen that I know of.
I don't understand your intentions: do you not want a wels, due to housing issues? If so, there is a plethora of wels-look-alikes in wels genus and in the family, for instance Silurus biwaensis and S. asotus only grow to ~3' but look much like wels. Study the Sulurus genus photos and datasheets or the whole family:
