wut if you bought a fish that is alrdy dying?

I bought a fish from this one forum member 2 days ago (i won't disclose his name for now). since i bought fish from him be4, i trusted his words. he told me that the fish's fins got thrashed and just need a little tlc to make a full recovery. since it seemed to be a really good deal, so i went to his place to pick it up. i saw the fish in person, and it has considerable damage on its body and fins and it seemed really stressed. i was doubting whether i should buy it or not (even though it's a good deal, still had to pay alot of $$). however, the seller told me that it'll be fine, it'll make good recovery w/a little tlc. so i bought it.

after i brought the fish home after like 25 mins of driving, guess wut i see? the fish is alrdy belly up in the container!! :irked: i was scared that it was gonna die rite there and then. so i hurried to acclimate the fish and dropped salt and bumped the temp up and hoped for the best. however, it seemed useless, the fish couldn't stay in the rite position. it tried to swim around but all it could do is to wiggle vertically in circles. i watched in heartache, but there was nothing more i could do. :(

and sure enough i found the fish dead the very next day! :irked: i need some opinions from u guys. do u think the seller should refund the money to me? although there's no "7days life guarantee" among our forum transactions, but selling a fish in that kinda condition and tell me that all it needed was a little tlc...??? da's irresponsible to both the buyer and the fish :irked:

so wut is the correct course of action here? two options:
1). i should get my $$ back from the seller (and return the frozen body of the dead fish to the seller upon request).
2). i should take this as a painful lesson and admit that i'm a dumba$$ for trusting other's words instead of my own eyes and judgment.
 
You should ask the seller his opinions on it and if you can have your money back.
But if he doesn't give a refund, consider it lesson learned.
Next time you buy a fish in that condition get a verbal contract on a warranty.
Or better yet, don't by a F'd up fish......

I voted for 2nd option.
 
I am sorry but i voted second option like why would you buy a fish that appears to already be dieing and what do you expect :screwy:?.

Becasue if he s/he is already hurt how would it make a good trip just be stressing out and making its self worse.

I have to take 2nd opinion and vote with this guy! U SAW THE DAMAGED FISH! And honestly, u would of known the risk of taking him home!
 
I also have to add something why did you buy it was't like it looked nice or anything lol .
its not like the fish keeper held you at gun point and said buy this fish so why would you buy at top dollar :confused: and how could it make the trip in such a bad shape.

i did see the damage on the fish. however, there isn't a sign on the fish that says "yea, i'm gonna die soon, don't buy me". i have "rescued" damaged fish be4 and i take the owner's opinion on the fish's condition into consideration too. i had a beat up festae be4, and it made good recovery just as the owner said it would.
so when i saw the damage on the tig, yes, it was considerable damage, but i couldn't tell whether it's a goner or not. it did look to me like damage that can be recovered w/time. and when i was in doubt, i did check w/the seller for the fish's condition. he told me that it's healing alrdy and eating well, and just w/a little tlc, it'll make a full recovery. da's how i decided to buy it.
 
Sorry bro that's on you...You saw the fish in it's tank and went against your best judgment and instinct. Chalk it up as a loss and move on.

Personally if you knew.. That is your bad in my opinion.. If the fish looked fine in the owners tank .. Fine enough for you to think it was fine.. then what makes you think the owner could have known or thought any different. Really I cannot see why you are blaming him for misleading you when infact this is not seemingly the case. Unless however he can see the future.

I mean you trusted him in prevous transactions.. Enough so that you did this time.. And now that you both were wrong it is his fault?

Personally on spendy purchases I do not pay for damaged goods until they look like they are worth the deal.. Good deals are not always good deals ;) We all know this..

Many of us know that if it seems to good.. it probably is.

I could see if the fish were rolling in the previous owners tank how you could want your money back. This was not the case.
 
Sucks about it dying. Such a beautiful fish...And you got it for such a good price too.
