wut if you bought a fish that is alrdy dying?

I would say a refund seeing that the fish was dying on the way home. But you accepted the fish and took it into your possession. So basically you accepted it.

Ok fine fair enough you have done this before healed fish but how could the owner predict it is going to die or not he did'nt predict it would die the next day or whatever you and him saw the same thing so how was he supposed to know ? you took the risk your problem you should of said i want to talk aobut the cost its got damage so take x amount away from price ECT .
 
You should have asked him to put it in a recovery tank and see how it does for a few days before any money is exchanged. That way the fish might survive the trip home if its some what healed before the move.

I think you nailed it with this sentence. if you are experienced and the owner is too.. Then this sentence literally clears the seller of any intentional malice in my opinion. As there is no sign on the fish for him to know either...
 
I am thinking that the reason you got such a good deal was because of the shape the fish was in. So if the fish would have lived and healed up would you have promtly paid the guy the rest of a fair market price of the fish. ----NO---you were gambling and did not win this one.

this is like wanting your money back if you buy a house without a roof, and then getting mad when it strarts to rain .

You knew the fish was in bad condition, and I guess you know that it is stressfull for a fish to be moved. and stress is not good for fish.
 
Legalities, technicalities, and the smart thing to do all aside here.. the honorable thing for the seller to do would be to say,"Oops,, this sucks man. Here's your cash."

Now to continue,, did you bother to talk to the seller before you posted here?
