So why they are for sale on aquabid if the seller cannot import them across the state lines?

Seriously? They're on aquabid for the same reason there are occassionally gars in CA lfs, rays in TX, and SHs in FL lfs. ...complacency, ignorance, ambivalence, etc of local laws and fish IDs. All this coupled with the same issues mirrored with the regulatory agencies. There's a larger percentage of agents unfamiliar with the species they're tasked to regulate than there are knowledgeable agents. Of course, this all means nothing to the conscientious hobbyist that chooses to follow the laws despite the faults within the industry and regulatory agencies.

A small elaboration - correct me please if I am wrong. I have heard that any one can apply but the only ones with any history of approval are the ones that aim to use them for either public educational purposes or breeding/research purposes. No one will be allowed to have the potentially invasive species for entertaining or aesthetic or pet purposes.
 
Not completely accurate. Anyone may apply that has a reason other than personal use. These cats are aquacultured in other countries as a food source. However, that's not likely to occur in the US since there is already a cold-water catfish market in species that are cost-effective to raise. Personal-use permits may be considered for state level prohibited species. I don't know of any permit application for federally banned species.

and if they are banned in all states then the guy is selling them illegally? cuz he lives in Oregon or should i say the pet sore they are being sold at is in Oregon
 
In two of my books they arent even listed as clariidae, their listed as heteropneustidae. A different family all together so, they may not be covered under the clarius ban. Ive personally seen them for sale three times at various places in oregon in the past few years. The wet spot has them now, i saw them at the world of wet pets in beaverton and pet n pond in clackamas. I had one up until last week when it somehow vanished from a completelly covered tank. That tank was damn near sealed and i still havnt found it anywhere in or out of the tank

It's a possible misidentification and we are talking about a completely legal fish like a Bullhead.

---I was referring to private-use applications. The federal gov't has no permit application for pet keepers. That's controlled by the state where the animal is to be maintained.

Federal gov't applications and permits revolve around importation, customs, and commercial/institutional maintenance of restricted species.
