Yes it is very illegal. Opium comes from a poppy. There are many different types of poppy plants. He probably has one of the legal versions.

Technically all poppy's except those line bred to be stronger (strains from SE Asia and the middle east) are legal, its just illegal to do anything with em but grow em for the looks. And as far as I know making pod/seed tea is legal

Making pod or seed tea from any given poppy other that opium poppies will do nothing to you but help you to fail a drug test. No pain relief at least.

Probably not unless the cop has a green thumb and is a backyard botanist in his spare time.

In the Seattle area these poppies grow everywhere. Public parks, school grounds, private gardens, etc. I don't think growing them is illegal, I think processing them is.
