An American man may be fined $500,000 and jailed for up to five years for shipping four Alligator gar to Japan.

Loren Willis from Florida was found guilty of two counts of trying to illegally transport fish out of state in September last year. Willis had gone out fishing in Texas with two Japanese dealers, an accomplice and a guide and another man to catch four four feet long Alligator gar (Atractosteus spatula).

After unsuccessfully trying to ship the fish directly from Houston, he then drove them back to his house in Florida where he kept them in a backyard pool for several weeks before shipping them to Japan.

A neighbour said Willis kept a large coffee can of fish food nearby and made sure the water was being circulated. She added: "[He] treated them like babies."

The trial was the culmination of a nine-month joint investigation between the Texas Parks and Wildlife Department Special Operations Unit and the United States Fish and Wildlife Service investigating multiple individuals who were taking Alligator gar illegally from the Trinity River, and subsequently selling the fish domestically and internationally.

Willis and his co-defendant were subject to a 'sting' as their guide was actually a paid government official and the other man was an undercover agent with the Texas Parks and Wildlife Department.

The U.S. Fish and Wildlife Service had been tipped off after Willis repeatedly rang them for advice about catching and shipping Alligator gar to Japanese Corporations. He was told that he needed a license to fish for the gar but he never applied for one.

After three weeks he shipped the gar via a Florida based fish distributor to Japan where there is a burgeoning market for "monster fish" which are kept in huge aquariums.

Documentation provided by the importer falsely listed the fish as farm-raised and not wild or as originating from Texas. He was paid $15,000 for the fish. Larger eight foot long Alligator gar have been known to fetch as much as $40,000 in Japan.

Thomas Burbank, Willis' attorney said: "It amazes me that the government would spend tens and tens of thousands of dollars on the case for four Alligator gar that if you talk to anyone in Texas, they are a nuisance fish."

However a fisheries biologist stated that Alligator gar are at risk of becoming threatened and highly vulnerable to overfishing.
 
I don't see why he just didn't take the time to get some babies and grow them out; it's not like they grow slow...

That lawyer's a real *** though; it's that kind of mentality that has lead to the current wild status of many gar species.

alligator gars aren't in any danger in texas apparently, they're perfectly legal to catch or hunt with a basic texas fishing license.

his alleged crimes are that he transported the fish across state lines without the proper permits and labeled them as "farm-raised" instead of wild caught (in violation of the all encompassing lacey act), also he apparently never applied for a texas fishing license.

the lawyer's assessment is fair imo. he's being punished for not following the proper procedures (i.e. jumping through the legal hoops), not for taking a threatened or endangered species. gar fish are popular with bow hunters in texas.

he could have done it all perfectly legal if he was willing to pay and wait for the proper permits. apparently $15,000 was enough motivation to take some shortcuts. the sad part is that they spent all this time and money to HELP this guy commit a crime instead of helping him with the paperwork.

There is currently a one fish per day bag limit.. Possession of more than one is illegal even if it is spanned over a few days. Your assessment of their population and structure is also flawed.. They are VERY much in danger from a wide variety of causes.

The Lawyer as far as I'm concerned is a douche that knows nothing of Alligator gar and it's assessment is flawed..

whether he intended to break the law or not, they still helped him do it instead of preventing it. that's called being an accomplice. if it was you guiding him to the fish instead of a government agent, you'd be in trouble too.

"their guide was actually a paid government official and the other man was an undercover agent with the Texas Parks and Wildlife Department.". true, he didn't have a fishing license (a very minor offense) but he did ask usf&w for help regarding exporting the fish. he tried but couldn't export it from texas because he didn't have a fishing license (part of the documentation needed to export the fish from texas) so he drove them home to florida to export (crossing state lines with wildlife, without a permit, is what they got him with). i read somewhere else that the charges of mislabeling the fish were dropped.

What are you doing in a gar forum where people talk about Gars and appreciate them? Really I'm seriously wondering about this.... Essentially your saying that some dink of a douche should get a free ride and be let off for openly and illegally dealing in these fish, Taking them from the wild where it is prohibited to do so, openly violating state and federal law and then you somehow have the nerve to try a delegitimize the protection of these fish also.. All I'm saying... as to break down the actual data that involves Alligator gar and the strong need for their protection will most likely either go over your head or as I pretty much get so far will not really persuade your dismal misinformed opinion of these fish anyhow. No use in continuing and I certainly do not care to communicate with those of your flawed and really ignorant assessment of Gars and the very needed controls that are finally being put into place to protect them..
