I hope all of you guys that are out money get your money back. Fraud is a touchy subject that isn't always easy to prove, so I would recommend that we don't throw around accusations so easily. Now my view of Tom is that he is sort of like your LFS. He sells you fish (at a discounted price) but I don't think he really knows enough (about fish species) for his own good. He usually relies on his suppliers to tell him what fish they have. He's really a good guy just trying to supplement his income buy selling fish. I know first hand he sold boxes and boxes of Indo Dats without to many problems. I sincerely hope everything works out for all parties involved and that everyone gets their money back. I will reserve judgment until all the facts are in.

Do you have all the PM's and email from Tom? I think you should file a police report for criminal fraud.

"Black's Law Dictionary (8th ed. 2004) defines fraud as "a knowing misrepresentation of the truth or concealment of a material fact to induce another to act to his or her detriment." The injury in fraud is usually depriving a person of money or other property that rightfully belongs to that person."

I suggest filing the report as a simple "theft by deception" charge, you do not want to have to prove anythng extra........part of the remedy.

Depending on the amount the Op is out is very important.

OP can file against Tom, all the secondary victims only have recourse against the OP........no recourse on Tom. That is why I suggested OP should try to keep his victims happy while he tries to remiburse them. Most of the "remedy" is in the last, closed thread. A few phone calls and some serious pressure could be applied to MR Tom if you work with the authorities.

The part that threw me off was that both threads GATF, and the dat thread, sounded EXACTLY alike, nobody could produce photos of a very rare fish. I was really surprised anybody would invest in a another thread like that.

To be honest, seeing Tom's recent history I cannot see the investment by the OP in the dats. A little transparency, by disclosing the supplier earlier could have prevented much of the fallout you are seeing now.

After reviewing the original sale thread, and it will be reviewed if you file charges, there was a lot of interplay between Ryan and Tom to stir up the sale, at one point Tom says:

"they are not e -legal here,,,,, bro i hate you i've been trying to get some from my guys for very long time know!!!!and so-far no go "

To be honest, if Ryan was using Tom as a supplier, he should have spoken up a this point when Tom was trying to put distance in between them with the underlined statement above. In reality, now Ryan has implicated himself by not divulging who the supplier is, seeing that this supplier was just recently was involved in a large scale fraud, with a similar scheme. By not divulging the supplier, in a direct way after the intentional lie by Tom, the secondary buyers are being denied basic information they would need to make the INFORMED decision on whether or not to buy.

Transparency, especially when both parties are rallying the sales thread woud be an important part. Ryan may have been defrauded, but his apparent collusion with Tom, when Tom publicly removed himself from the transaction as the supplier, does not look good.

i will agree i talked to tom for a few months, after talking to him and doing business with him a while he seemed very trust worthy- which is what he must of been striving for the whole time......

alot of it actualy happened before the tiger thread, and he had his f'n tiger situation 'covered' well with his explanation, since some people actualy did recieve some tigers from him and he said it would take 2 weeks for more to come in, (which would of been this past monday)

as for the legal action thank god for mfk pm notification everytime i get a pm because i was able to go back and find some good stuff sent by him.

I would take some time and draw up a detailed timeline that supports your stance, with supporting docmentation. With all the information that is presented just in these threads it is important to cover all the bases. If you have additional information, that is great. Like I stated earlier him removing himself as the suplier, by his comment, rendered the secondary buyers "informed information" as false.
