Now that the pics are better I can officialy say toad, but now we need to find out what species it is. Lets get those foot shots in.

well, now that we know hes a toad for sure, how should i go about setting up his tank? right now its about half land/half water but im sure he needs more land area than water considering hes a toad. Should i buy some of this,http://www.petco.com/product/5399/T-Rex-Forest-Bed-Expandable-Substrate.aspx, keep the soil moist, and place a small water dish in the tank for him? anything else i need to do??

I think you're on the right track, definitely add more land. Like you said you could just add some of that type of bedding and place a shallow water dish in the middle. Give the toad a place to hide and add some live plants and I think you'll be good.
