NEWS FLASH Some people do this stuff with these fish for more than keeping them in Glass boxes. Those whom know us know we do not generate "opinions" we give factual up to date and relevant info. Maybe sometimes it is not always fully spelled out because.... Well.... We like it when you think about things sometimes or actually look the stuff up yourself sometimes.

Your letter does nothing to support your argument that gars are illegal for import. It only refers you to Article VII, 012 C, Which I have read several times and it states nothing about importing of gars. All information regarding importing is in Article VII 011, but states nothing of any individual species. I was hoping maybe you had found more, but I realize now you are only going off of your misinterpretation of Article VII as a whole. Whether it be the actual article or an email you received referring to it. Maybe the true answer regarding importing may land within either Title 33 or Title 35 C.R.S.

perhaps you should contact the person in the email (Kathy Konishi) and ask for yourself...go to the folks actually in charge or at least working for said supervisory organizations...and stop wasting any more time here.--

PS-- and part of the frustration is coupled with the fact that this same conversation came up a couple years back and had the same general ambiguity...like many many threads on the forum. people have the interwebs and correct contact people, so use that - you'd be surprised as many of these management organizations will get back to you with the updated regulations or refer you to someone who may know better.

that being said, we've already more or less established that if you have a gar in colorado right now, you're probably not going to jail. it may be costly if someone tracks you down and you're busted, but if you play it "cali-cool" and don't draw unneeded attention to yourself you won't get into trouble in this case. is it necessarily right? probably not, but is it a practical way to deal with all this crap? yes.

Dude I've already done all of this... Do it your self and find the answer if you so wish. And yeah I am full of myself as I bothered to do this homework some 5 years before this thread then about 2 years ago again to keep it current as well.. Nothing has changed.

Piss match over and I'm done here.. You have the info now to do all of this on your own. Go forth and prove me wrong...

If I am wasting time it is only my own. As I have stated before Wiggles can PM pwmin he has done the legwork regarding this. He himself has brought in many species of gar from several different suppliers. Wiggles could even PM MTN PIKE who is a licensed importer and has also brought in gar, he may be able to shed some light on the subject.

Figured you would want only correct and valid info to be posted within the Stickys of the gar forum, but then again maybe I am just wasting my time. I will be sending an email to said authorities to try and clear this up. Whether or not I decide to waste my time posting the reply, well that is yet to be decided.

i had an entire post in mind about how in reality most time spent on a forum IS a WASTE of time, but then decided that posting a reply to a response about a waste of time stating that it was a waste of time on a larger collection built upon wasted time was actually a waste of time.*

i still sort of did this, but wanted to waste some more of everyone's time. people have the same ambiguous info to deal with/dream about/pursue further as they choose...and it will all come up again in a few months/years.

i hope you find answers to your satisfaction eventually--

Wow, I don't log on here for a little bit and then some interesting stuff happens!

Okay, after reviewing everything here's what I've obtained from the regulations:

  • "All aquatic wildlife [which would include gars] being transported within Colorado must be accompanied by, and may only be transported within Colorado pursuant to:

  1. A personal or commercial fishing license,
  2. A donation certificate,
  3. A receipt from a commercial or private lake licensee, permitted aquaculture facility or permitted pet animal facility,
  4. An aquaculture facility permit,
  5. A pet animal facility permit,
  6. An importation permit, or
  7. A bill of lading or other similar documentation evidencing that the wildlife is being transported through Colorado for delivery in another state and containing the name, address and phone number of both the source and receiving person or facility.
Original documentation is only required when transporting aquatic wildlife pursuant to a personal or commercial fishing license, a donation certificate or any kind of receipt. In all other cases, legible copies of the required documents will suffice." (Chapter 0, Article VII, Section 010)


Now then, based on these regulations, one can legally own gars in Colorado provided that they acquire them directly from a licensed importer or from a permitted "pet animal facility" (e.g. an LFS) that acquired them from a permitted importer. It should be noted that these regulations imply the one may not acquire gars from someone/someplace that is not properly licensed in the state of Colorado (e.g. fellow unlicensed hobbyist in Colorado; out-of-state hobbyist/breeder/LFS/importer/etc).

So, in conclusion, Colorado has a very confusing set of regulations regarding aquatic wildlife that basically say, "Yes, you can have them [gars], but only if you get them from someone/someplace who/that is licensed to import them."

So, yes, Richard (Pejelajarto) was correct on the importation/possession part as was Brian (Bderick67) on the part about MTN PIKE (American Cichlids.net) being a licensed importer of at least some fishes. I can't verify if MTN PIKE is licensed to import some or any of the gar species since I can't find any record of them even having gars for sale on their website and am unable to locate an licensed importer list for gars for the state of Colorado.


Also, if anyone has any specific regulations or whatnot for any state, territory, country, etc. that can be added to the "Gar Legality Around the World" thread, please PM them to me along with the link(s) to the actual regulations.
