Different states have different laws regarding tips and minimum wages see the link below.

http://www.dol.gov/whd/state/tipped.htm

BTW if my server has done an acceptable job I tip about 20% figured before coupons are taken off or taxes are added. If they server did not do an acceptable job, both them and their supervisor are told about it.

It entirely depends on state. The minimum federal wage for tipped employees is $2.13. After that it's entirely up to state law.

CA is $8.00 an hour for tipped employees. Like I said, here it's $8.95 an hour.

thanks bderick. this is what I also found on the website you provided. federal law min wage is $7.25. so if i'm getting this right, every single state needs to pay at least $7.25 right?

BUT about tipped employees, DEPENDING ON THE STATE, if the pay for tipped employees is under min wage, and any tipped employee after working doesn't make at least min wage, then the employer must pay the difference to that employee. so no matter what, EVERY TIPPED EMPLOYEE MUST MAKE AT LEAST MIN WAGE ONE WAY OR THE OTHER. here is a quote directly from the site

http://www.minimum-wage.org/minimum-wage-exemptions.asp

Any worker who earns regular tips (specified as earning at least $30 in tips a month by the FLSA) is eligible for a special minimum wage rate. Employers are permitted to pay tipped employees an hourly cash wage of as little as $2.13/hr- however, if this wage and the tips earned during that hour do not add up to at least the applicable minimum wage, the employer must make up the difference in cash. Thus, tipped employees are guaranteed to earn at least minimum wage, and can earn more then minimum wage in tips.

are my observations right? if so, then screw that, i'm no longer tipping 10% ever. 5 max. and unless I misunderstood the site, all who argued "but they make under min wage!" can eat crow because that argument just went out the window in a blazing ball of fire

Yeah sumo, that's my basic understanding as well. Honestly I only found out about all this last year talking to a friend who moved to Georgia telling me how little they paid there. I have only ever lived in CA or OR so I just assumed all servers got paid hourly about what everyone else does. Explains why service positions are always in high demand here I guess.

ok, this is huge, this is freakin huge for me

I think i'm gonna start tipping 2% max now. or it's gonna be between 2-5%, 5 being max

more awesomeness for me from the site

The California minimum wage for tipped employees is $8.00 per hour, higher then the federal minimum wage for tipped employees of $2.13 per hour. The California tipped wage applies to employees like waitresses, waiters, bartenders, valets, and other service employees who earn more then $30 in tips a month.

Including tips and cash wages, all tipped employees must still earn at least the California Minimum Wage of $8.00 per hour. If a California employee does not earn at least $8.00 including tips in any given hour of work, their employer must make up the difference in cash.
California Tipped Wage Example: Amy works in California as a waitress, and earns over $30 in tips a month. This hour, Amy earned $3.50 in tips. Her employer must pay her a cash wage of at least $4.50, to bring her total earnings for the hour up to the California minimum wage of $8.00. Annette, who also works as a waitress, earned $10.50 in tips this hour. Because she is already earning at least the minimum wage, her employer can pay her the California tipped minimum wage of $8.00 for this hour.
California employers who hire tipped workers like restaurants, bars, and cafes may deduct a tip credit of up to $0.00 from the minimum cash wage paid to their tipped employees, and can pay as little as $8.00 per hour for hours where the tipped employee has earned at least $0.00 in tips.

Now the thing that will really irk you Sumo is federal minimum wage is $7.25 an hour, so every west coast state pays higher than that plus tips. :)

Honestly, it puts me in a moral dilemma. I've always tipped well. I tipped 25% today to a place I frequent, but the service is good and everyone there works hard. It seems like when I was younger, serving positions had a lot more women in their late twenties to early forties just making ends meet to help support their family. Now it seems like in my area the majority of servers are young college aged kids, a lot of which have poor attitudes, just looking for party money.
Maybe in some situations I should pocket the tip, save it up, and give it to a good charity. Children's cancer, animal shelters, I dunno...

oh yea dude, here in cali, they get paid $0.75 more per hour than what federal requires

but i'm actually very happy with tonight's new findings. I will now go out into the world and eat out with new eyes

my stance on this whole topic just got 10 times stronger. thanks to all for participating and special thanks to bderick

The minimum law doesn't apply to waitresses, waiters or barmaid, at least in my state. Heck at pizza hut here they only pay like 3 or 4 bucks an hour to waits because they are tipped employees. And I know several bar server/waitresses who only make a little over 3 bucks an hour. These type of employees are dependent on tips, so it's only right that someone who waits and serves my needs gets paid accordingly. If they are good they get a nice tip if not I leave a few pennies then they know they need to improve. And if it is really bad I leave a complaint with their boss.
To each their own, but if someone is going to physically take care of my needs and provide me with a pleasant experience I show my appreciation.
The only ones I have an issue with are like pizza delivery, they make minimum and then the pizza restaurant adds a delivery cost to your bill then the driver expects a tip when they are getting 2-3 bucks per delivery from the store they work for on top of their minimum wage.
