That's why I built a nearly soundproof recording studio in my house. no neighborhood association, but the wife would kick me out since it's next to our bedroom. Now I'm getting loud until 1am with no complaints!

Lol , they sent me a letter advising me to purchase drum pads/silencers!! Whats the point??

5am was a reference depending on whos over or if its a party then im liable to pick up the sticks at any time with booze. Like when i shot a mortar(firework) out my window at 4am and almost lost my hearing.

Thats what happens when ur 24 and have waaayyy to much freedom but i worked for it so im going to enjoy it!!

Which one is cheaper, lawyer fee or get rid of 9 tanks?

We've been looking for places to move for about a month.
Honestly - I'd rather keep my fish& move away from these old nags.
This complex is more like a retirement village.
They are always complaining/yelling at my kids to go play in the woods out back, instead of in front where I can see them. I know it's probably highly unlikely, but there are coyotes& my 9 yr old isn't exactly a big girl.

We are on the second floor. Floor is cement slab& the biggest setup is a 120 with a 40breeder inside the stand. This floor can hold any of my setups without a problem.

EDIT - *the biggest setup they've seen in here. I have a 125 with a 100long under it, in the bedroom.

Sometimes it's worth a fight, and sometimes it's easier to just move on. They may be using your tanks as a reason now, but if you stay, what will they use as the next reason? I even heard of a guy that was going to buy a house in a new subdivision, had all the paperwork ready, down payment, everything, then they spring it on him that the only vehicles allowed will be cars - right after he bought his new F150. How can you tell people they can't drive a freaking pickup truck if they bought it! He argued the point and got them to write it into his HOA agreement so he could keep the truck but it has to be garaged, and can't be parked in the driveway or street. What will the neighbors say to that, I'm sure that will start a fight somehow. Personally, I would have taken my money elsewhere.

When we when looking for a house, having minimal rules were mandatory, we took the real estate agent to exclude anything with HOA or neighborhood rules.
 
As someone who has delt with HOAs for YEARS, it's not about the tanks or the weight of them. If you are selling fish, they are considering it running a business out of your home (as per the wording used in post #6). I've NEVER seen an HOA allow that - and it's usually right in the contract. They have very solid ground to stand on legally.

Sorry to say it: I'd get rid of the tanks, and highly suggest not bringing them back - as they will have you on radar for awhile.
 
I'm responding to the letter saying why No violations have occurred& then will take it from there.
As far as selling them, I have not done so, yet.

I know they're going to keep harassing me. We have been trying to find a house to rent.

Maybe we can come to an agreement where I'll leave& can keep the tanks. (Since they don't know I'm leaving anyways)

As soon as you said "yet" - you are in violation of the rule, so they have you. Someone around you has picked up on the fact that you plan to do so - therefor fall subject to the notice you got from the HOA.

It's actually a GOOD rule. It keeps people from operating things like puppy mills, machine shops or any other business out of their home that will take away from the property values of the other homes in the HOA. Could also be because it's zoned for residential use, and NOT commercial - so they have them to stay in line with city laws.

I'm very happy about these types of laws. Keeps my neighborhood an area that is safe, quiet and livable.
 
sounds like someone is part of a hoa... personally i would never live in any community with a hoa. Good thing they are not popluar where i live. Only in condos and what not.

I used to volunteer for a place that helped people fight evictions and prepare their divorce cases. I don't know where you live, but I live in the LA area and we have the Legal Aid Foundation here. Maybe there's one by your city. If there's not, call your state's bar association and ask them foraa public interest firm through that handles evictions. They'll help you prepare the paperwork and give you some advice if the association is trying to evict you. it sounds like they don't have much of a case against you, but I would get some free help at first just to be sure.
