It messes up cognitive reasoning. So you can't be held responsible for decisions made when not of sound mind. And because it is a temporary condition no treatment is necessary. (like being held indefinitely in a psych ward while they cure your insanity)
And if you are acquitted no record of arrest, trial or history of defense is considered the next time you use it.
I did once hit the same judge twice so didn't try it. I plead guilty to a minor offense. Because I had no similar convictions on record I fell into first offense status, was found conditionally guilty. Had to pay a large fine to a charity of choice from a given list (Diabetic Foundation). I negotiated the fine down, as it was hardship, citing I clearly had no money, why else would I be stealing?
After 1 year of no similar arrests it was taken off my record.

Oh' I had no similar convictions within 3yrs so was of first offense status.
There were similar arrests, and acquittals. That could not be entered because of the acquittal.
