Yes, they should have given it back to him. How many times does a fisherman like him catch one of those without the intention, especially ones that big? Who cares wtf he caught it with, he never even learned you couldn't catch one with a net. It bothers me you agree that what the feds did was right...:headshake


He took it illegally - plain and simple (and chances are he very well knew it). It gets snagged by the gov't as a result. How is this not the right way of enforcing the law?

By taking it illegally, it becomes a black market fish. Giving it back allows him to sell it and profit from a black market fish. Not exactly the type of thing the gov't should support. What next, give the drugs back to the smugglers to allow them to sell it??

just to throw it out there.. only way to keep people honest about these kind of things are a simple choice.. present them with a lie detector test, did you or did you not know, and was or was it not an intentional catch.. if he fails the test, fine him with double the fishs' worth.. if he walks away from the test, sell the fish and give the money to wild life preservation..
 
I'm not too sure about the lie detector test....Quite a few places no longer use them due to inaccurate readings.We had it strapped to us back when I was going through the hiring process at my job, but now,years later, they have stopped using it,same thing with the police department here.....I see your point though,if someone isunwilling to take the test then they appear to have something to hide.
