They're legal in most of the mainland, although different states have different regulations.
For whether they're legal in Hawaii, I checked Hawaii's Division of Aquatic Resources website and can't find any information saying they're illegal. I would assume this would mean they're legal, but I don't know Hawaii's laws specifically. you might have said it earlier in the thread, but what size tank is he in now? once i know this i should be able to give you an accurate estimation, and if not im sure someone can.

i heard its good for gars to start in rather smaller tanks and upgrade as they get bigger and bigger to prevent them from inflicting injuries to themselves.
