If your nitrates are at 40, today would be better. 40 or higher is unhealthy for fish, but it does sound like your filter is functioning properly now.
 
Is this the tank you picked up from that guy with the armatus? I recall you saying it seemed to of had ammonia, if it did for any lengthy period of time it could have been absorbed by the silicone and is now seeping out into your water, this could be the problem.

Damn I would hope not I cleaned the whole inside with vinegar and I even sand it anf buffed it out, I'dk if any of that would help...

I never knew of solutions for this. I learned this the hard way. I was always into all animals, so in 5th grade I had some small fish in a 29g and a python in a 55g. Everyone was growing so my mom got me a 125g for my python and we figured we'd move the fish to the 55g, well as I'm sure you know the ammonia from reptiles pee gets absorbed by the silicone, had the snake in there for 3-4 years... long story short I lost all the fish and got a new 55g.

I believe the tank is acrylic..so there is no silicone
