PM pwmin, he did some researching on this for gar as they are also on the list. From what I remember there are OK to have as long as they are for the private aquarium.

Already very well answered but, not ok to have in Colorado. Most places will have them from time to time, just not for sale (wink). It's only really on paper though, the last place I worked at managed to get piranha's delivered to the door via online orders. If you want them, you'll have no problems acquiring them.

A. Except as provided in these regulations or authorized by the Division of Wildlife or under Title
33 or Title 35 C.R.S., it shall be unlawful for any person to possess any live native or
nonnative aquatic wildlife in Colorado.

B. No person shall, at any time, have in possession or under their control any wildlife caught,
taken or killed outside of this state which were caught, taken or killed at a time, in a manner,
for a purpose, or in any other respect which is prohibited by the laws of the state, territory or
country in which the same were caught, taken or killed; or which were shipped out of said
state, territory or country in violation of the laws thereof.
C. Except as provided herein, the possession of the following species, their hybrids or viable
gametes is prohibited:
1. Bowfins: Amiidae.
2. Carp of the following genera: Aristichthys (including but not limited to bighead carp,
Aristichthys nobilis); Catla (including but not limited to catla, Catla catla); Catlocarpio
(including but not limited to giant barb, Catlocarpio siamensis); Carrassius; Cirrhinus
(including but not limited to mrigal, Cirrhinus cirrhosis); Cyprinus; Hypophthalmichthys
(including but not limited to silver carp, Hypophthalmichthys molitrix, and largescale silver

if i read the red right as long as they are in a private aquarium and even seem ok to buy. this is very encouraging and i am now going to take a p or bust thought process. and when it comes time to buy piranha's i will check Fish Palace and Aqua Imports.

of note is: 6. frog, green i got a giggle out of that.

"Or as pets in aquaria" does not pertain to Ps in aquaria. According to Chapter 13, private aquaria refers to student aquariums where wild specimens collected under Ch. 13 collection regulations may be retained for bonafide research programs in approved licensed private aquariums per Title 35 Article 80.

Title 35, Article 80 is the regulations pertaining to licensed animal/pet care facilities.

Neither of these regulations has anything to do with keeping Ps in home aquariums.

Have you followed up on this regarding "or as pets in private aquaria" or is this your interpretation? To me the use of the word "or" separates the authorized possession into three categories, where as you seem to try to put it into just two.

I have not followed up on this, I know Paul (pwmin) has. I could not find the thread I was looking for on this though. I have PM'd Paul seeing if he can shed any light on this.
 
Title 35, Article 80 has a 'private aquarium' stipulation unde rthe conditions of a student being permitted to maintain study specimens, at home, when under the direction and licensing of a professor employed by a properly licensed research institution.

The Wildlife Commission retains the statutory authority and duty to amend these regulations and to impose requirements, restrictions, and/or prohibition on possession of any of the listed species if and when further evidence comes to the Wildlife Commission's attention which makes such amendments appropriate.

currently, the position of Kathy Konishi (who used to be in charge of permits) is being filled. If what I'm saying isn't good enough for you, I'd encourage you to call the DOW and get a hold of the chief of law enforcement. Phil Goebel, the other person that used to know these things has retired and his position will not be filled most likely, definitely not anytime soon.

That's not how the law reads but, if they want to let it fly, ...what the hell do I care. I just pass on the laws as written.
