I think a citizen assisting in an arrest is a bit different than this situation. Maybe i am contradicting myself by saying now the law can be interpreted. But in this case the guy is taking the car for no lawful reason, i think anyone in a position of authority would have advised him to just take off. He wasn't being immediately threatened once he was out of the house.

I dunno, i don't know any details. Is there an actual news story floating around? It just seems like the operator was cautioning him, what would you say if you were the operator? Probably whatever the protocol is. Its a sketchy situation....

I want to buy that guy a beer!!!!!!! He's awesome, a quick thinker right there. We all know there are certain things you just DON'T DO. We learned most of them by the time we were 5 years old. One of them is, "Don't take things that aren't yours". If you DO take something that's not yours, you know in your mind you are in the wrong, you have crossed a line of moral acceptability. You should also be prepared to accept the kick in the ass that comes with it, in whatever form it arrives. People who try to blur or cross out this "line", are just promoting the theory of "I am just too special to be held accountable for my actions and the blame is definitely not mine because I never got enough love as a child, yakkity schmakkity.

here in Portugal i go to jail if shot a guy robbing my house, i can get 15 years
every day its getting more crimes , if you are a killer that murder 10 guys
but before the cops get you ,if you turn your shelf
they have to let you go until you go to court, that can take a year and you are free, if you do a crime that the jail time is under 5 years , you stay free until the end of the trial,

No way, this guy has every right to do this. I would do it too. This is almost like someone pulling a gun and trying to shoot and you taking the gun away and shooting them. I would expect to not be charged with anything.
 
I thought it wasn't considered stealing a car if the keys were in it.

A state cop once told my buddy that if they were ever getting robbed to make sure you shoot them inside the house, and if they make it out a window pull them back in. It's legal to shoot someone that's broken into your house but if they put a foot out the door it's illegal.

Thats all that matters here, and thats the question. Its not should it be a crime, its either a crime or its not. This has nothing to do with guns, assault, etc...

Not really, law is a fluid doctrine that is left to be interpreted by judges. Violations of law are treated differently in different circumstances. I highly doubt you will find a judge or jury who will actually convict this person.

On that last sentence, everyone stop whining about a huge miscarriage of justice here. The guy was arrested by a police officer, not a supreme court justice. You do realize how much training in law cops have right? He made a judgement call (playing it safe) and left it to a judge to decide.
