Should it be illegal to take the robbers get-a-way car?

The law is written on paper, and must be that way so it serves everyone. Its why lawyers are an interesting breed, they can see the law and look past the human aspect of it.

Its a simple question, is he breaking a law?

No. He called the cops from the vehicle. How many criminals call the cops while in the act? He was assisting the police in their capture. Let me ask this.....I've seen videos of criminals getting the upper hand on cops (during traffic stops, whatever), and beating them. Then people passing by jump in and start attacking the criminal. Why are they commended rather than prosecuted for assault?

Is that a crime? Yes

Thats all that matters here, and thats the question. Its not should it be a crime, its either a crime or its not. This has nothing to do with guns, assault, etc...
 
this kinda reminds me of the situation where you shoot the guy whos attacking your family and you get sent to jail for the crime.

I never mentioned guns lol. How is this example any different than mine? How can someone say this is a crime, when my example is not? They are, by the standards of being written law, the same thing, crime. They are both also assisting police. He did not STEAL the car. Did the TRUE criminals report their van stolen? Likely not. They accidentally left it running, backed into someone elses driveway....oh, while they loaded the victim's belongings into said van..... So, if he blocked them in the drive, rather than "stealing" the van, I guess would it would be kidnapping? If he tackled them, it would be assault. If he licked his lips at them, it would be sexual assault......:grinno:

How about....."Excuse me, fellas, I'm going to need you to put that stuff back where you got it. Also, your van is blocking my drive, so I'm going to need you to move it. Thanks, guys."

Or maybe....."Hey, you guys need a hand with that? I don't want to get in your way and have to go to jail."
 
I wasn't referring to your post with the mention of guns.

I think a citizen assisting in an arrest is a bit different than this situation. Maybe i am contradicting myself by saying now the law can be interpreted. But in this case the guy is taking the car for no lawful reason, i think anyone in a position of authority would have advised him to just take off. He wasn't being immediately threatened once he was out of the house.

I dunno, i don't know any details. Is there an actual news story floating around? It just seems like the operator was cautioning him, what would you say if you were the operator? Probably whatever the protocol is. Its a sketchy situation....
 
Wow, interesting thread. And I agree with having the right to defend ourselves against criminals.

This one time some guy broke into our house while my mom was at the store, except she was coming home while he broke in. My mom pretty much went into psycho-mode and grabbed a frying pan and chased him out and beat him SENSELESS at the same time. She didn't even bother calling the police, they don't do ANYTHING here! They would have gotten here 20 minutes later and the criminal would be free on a technicality.

On the same token, I recall a story of Hollywood stuntmen who jumped on top of a car to block the view of the driver who was trying to get away from cops during a high speed chase. They were apprehended for "interfering" with the arrest of said driver.

Anyways, no it should not be a crime. I would have at least slashed the tires and taken the keys out of the car before writing down the license plate number.

ANYONE in my home, without my permission, that isnt some sort of law inforcement will be shot (multiple times). I would make sure my story was the only one that will be in the police report. I dont care if it is a legal or not. DO NOT come into my home. Children might be spared....

I will not depend on police do there job, and I would rather goto jail then have to call homeowners insurace and try to get anything out of them.

Do you really think the crack head is thinking with reasoning? pshh
