SPEEDING TICKET EVEN GOING THE RIGHT SPEED !!!!

  • We are currently upgrading MFK. thanks! -neo
Just go to court. Judge will dismiss your case, since you travelled at speed limit. Next time, offer the cop your cookie, let him know it's cookie, not "brownie!"

I got ticketed for going 34 in a 30 a few years back. Judge laughed, but still made me pay the fine :irked:

i had a friend whose mom got a ticket for driving 1 mile over the speed limit

yes, 1 friggin mile per hour over. she tried to fight it and lost. she paid the fine

I think you got an unsafe driving ticket. The speed limit may have been 65 but it was unsafe for you drive distracted while eating those cookies. You need to check you state and local laws. Many states now have laws banning cell phone use while driving. Our local WFMY NEW2 did a segment on other things that cause reckless driving. Eating was right there on the top.

what's misleading is that the ticket says "unsafe speed"

i'd agree if it was for "unsafe driving" or something

Yeah you may be able to get out of it for a technicality

In my area, the judge would ask you what happened if he doesn't understand the charge (which he won't) or give you an opportunity for defense, where you would just say, "I wasn't speeding, the ticket even says so. I was eating a cookie, and I was told I was pulled over for eating while driving." Then the judge will almost certainly dismiss it.

Many times, judges will even dismiss things that were your fault if it wasn't dangerous and just a misunderstanding.

Of course, I only know judges in my general area. Most of them aren't looking to catch you on a technicality and are actually pretty down to earth. Don't sweat it!

V C Section 22350 Basic Speed Law

Basic Speed Law

22350. No person shall drive a vehicle upon a highway at a speed greater than is reasonable or prudent having due regard for weather, visibility, the traffic on, and the surface and width of, the highway, and in no event at a speed which endangers the safety of persons or property.
In case you guys don't know, posted speed limit is 83% of actual safe speed limit, so even if you travel 10-15mph above the posted speed limit on freeway in a dry, clear weather condition, you still travel at a "safe" speed limit ;) However, if you do 65mph on freeway during heavy rain or thick fog, it could be "unsafe" speed.

I doubt that will hold up in a court. What's the basis for it? And where do the figures come from? Actual written law?

Well, I'd absolutely agree and no argue if I was driving unsafe BUT I was driving on the outside slowest lane, no lane changing, no following, so how is that reckless or unsafe ???:confused: :nilly:
