I dont touch expensive and/or delicate things in stores. Especially with a sign saying not to touch it. This is almost the same as being told or having a sign saying not to put your finger in a fish tank, and then being bit, then wanting to sue the store. People ignore warnings about not touching or putting your hands in an animals tank/cage, person gets hurt and then wants to sue.

If customers believe stores are liable when you get hurt, then you have to be liable when you break something of theirs, especially with a sign being posted not to touch it. Thats my opinion

I think you have rights as a consumer, but if there is a sign asking you not to touch it, I think you should have to pay for your lack of reading / disregard for store owners signs.

Thats why we have parents to slap us for touching something expensive in the store.. If you still need your parents to do that, then they should have to pay instead of you I guess.

One time I was at a stroe that sold trinkets made of glass and things like that. They had a lounge area were people can hang out. I sat down on this seat and when I did that the sit went backwards and I fell and hit this shelf and knocked down soem glass items and broke some of them. The store person looked at me and the objects for a second, then told me its ok, and dont worry about it.

I think in this situation they may have felt that it was their fault because I had fallen and I could maybe turn around and say I was hurt or something. If its store neglect like they placed something where someone could knock it over etc, then they would be held responsible. But lifting a canopy on a tank that probably required 2 people, having a sign saying not to touch it and ask for assistance, is not quite the same.

Even if there isnt a sign, it was broken fully by your actions. Had you asked for assistance and it broke while you and the strore employee were holding it, then you might not be fully responsible. Same would be true if their was neglect on the store where it was placed and how it was placed.

You have to pay for what ever you broke, whether you take it or not is your desicion, sure its an accident but its still your fault, not the biz's fault, foot the bill.... PERIOD

its the persons fault they should have asked for assistants - theres a sign on there for a reason. read.

if you make a mistake
then do the necessary to repair the mistake

That's why I don't touch ANYTHING in a LFS unless I ask first b/c I know it would more then likly break when I grabbed it anyway so I might as well have someone there watching to prove it was not done on purpose.
