i think all that needed to be said was said and the two parties can talk it out behind closed doors

hope all ends well in the end or at least gets put behind
 
This was just a nightmare! Those photos are shocking and, after raising those fish for two plus years, very difficult to look at. Hindsight is 20/20 after though and considering the circumstances I think the fault lies primarily with the shipper. How in the hell did the box get wet?!? (see ace ventura)
In the end Ira really had nothing to do with it. He didn't volunteer his services, you asked him to ship them for you. I say that not to defend him but rather to point out how this situation sucks for everyone involved. Granted, the packaging job looks like crap but not knowing exactly what those fish went through for those 48 hrs in 30> weather (exactly what we were trying to avoid right?) all we can do is second guess ourselves or one another. Fact is, we will never know the what ifs. what if there were no delays? What if Ira had used more bags, or heat packs? What if I had shipped them to you instead? Shute! what if I had never agreed to sell them in the first place? That's the one that gets me. this whole thing just sucks!
 
I think either way, if the package arrived on time and handled correctly the fish would have gotten there on time. It sucks that the package was not packaged 100% as good as it should have, and it sucks that fedex screwed up the shipping. This is one of those deals where if one side had not screwed up, it may have made up for the others mishap.

I think shipper and carrier are to blame. If one of the two had done an above average job, your fish would be fine.

I can agree, not putting full blame on Ira but also am not gonna put full blame on the carrier. I do also believe is was the fault of both but my post just leaned @ Ira given the accusations that were made.

understood, as I mentioned that he did it as a favor (not trying to hide anything) Like you say WHAT IF.......

but as far as him having nothing to do with it, I have to disagree. I asked, didn't hold a gun to his head and say your gonna ship these fish. He had 2+ weeks to say no and never heard a peep. Like you said you could have done it but I think we both assumed :D given his prior experience that he would be the safer route.

just so we are all clear on this I also think both are to blame but as stated by Ira neither party is accepting any responsibility.

I voted shipper.
Clearly the shipper did an extremely crappy job of packing the fish, and even though it was probably the delay that pushed the fish over the edge, it was something that fedex had no control over, so I don't think they are at fault

It was a crappy packaging job but the shipper had no control over the weather delay either.

IMO - Fedex knowing that this was an overnight for live animals and also knowing wether or not it would have a connecting hub transfer should have made the shipper aware of the delay like wise the shipper should have inquired and the delay would have been discovered and that 1 part of this unfortunate situation could have been avoided.

First of all, sorry for your horrible loss.

Since you clearly feel that it is the shipper that is mostly to blame you should settle this between you and him and not create this awfull , public, environment.

On another note, if you do not want other people's views on what happened to your shipment, do not do a poll.
