I guess the EU animal welfare act could apply to #1, but not sure how anyone would enforce that type of legislation unless there was a report of animal cruelty, and a follow up investigation. Even then who decides what's cruel, and what's not? I believe the rules below were from the UK act.

- the need to be able to exhibit normal behaviour patterns (such as exercise)
- the need to be housed with, or apart, from other animals
- the need to be protected from pain, suffering, injury and disease.
