Why you should NEVER release any fish

This should settle this. This is a reply to me from wildlife headquarters, law enforcement division.

OAC 1501:31-13-01 (A) (7) states that it is unlawful to release any fish or aquatic insect into the waters of the state or any area under control of the division of wildlife. (This would include all rivers, streams, creeks etc... in addition to any place a fishing license is required). Fish can be released into private impoundments.

It also states in our fishing digest and OAC that its unlawful to transport and introduce any aquatic species (fish, invertebrate, plant) from one body of water to another.

Was it not post #37 where this exact thing was written?
I even remember posting a direct link to it.....http://codes.ohio.gov/oac/1501:31-13

Wow imagine that.....The written law really does say that and Ohio really acknowledges it as a law written in that exact language.

Kind of stupid it took someone to write an ODNR official to clarify something you could google in a few seconds...

I agree it is settled as to whether it is legal or not. However,Polypterus, either you have zero experience with dealing with governmental agencies or are just naive. Government's interpretation of wording (i.e. "waters of the state") can change from one administration to the other, or even one employee or the other. Perhaps a civic lesson was needed. And I will once again ask what exactly it is you do and for whom you work. I wouldn't normally ask someone this, but when you claim to be an authority...

Aren't you the one that wrote an intern at Ask@ODNR a question about legality then argue it??? Do not try to turn this on me as being the naive inexperienced one....I'm quite experienced in working with state and federal agencies.. thank you..And it is also why I had a clear response to this from the very start.

You are the one that wished to drag this out thinking you where correct only to have this go full circle and go right back to post #37 as being the correct interpretation of Ohio law. Sorry, unlike many, I do not talk out of my ***.. If I say something it is generally because I know what I'm saying. My work depends on knowing current wildlife laws and regulations.

Which comes to my work:
I really do not care to tell you who or where I work, nor my official title. It does no harm for me not to do so. Most here that I care to have know my personal and professional affiliations already do know. Your not one of those I care to talk much to or work with in these matters.

I'm pretty much done with dealing with you so.... Ta Ta and I won't catch you later...
 
For some these laws can be difficult to decipher. The crime here was that a DNR representative, be they an intern or not, gave out false information.
MJMC contacted them thinking he/she would get an authoritative answer. Others here, you know who you are, have spent enough time reading these laws, that the answer was was clear from the beginning.
I do not blame MJMC for doubting our responses, as we are simply just some schmoes on a fish forum.
I am sure there are some good lessons to be learned from this thread.

And though I won't divulge Polypterus's occupation, I can confidently say he has more knowledge in wildlife law than 99% of the users here.
 
I am humble enough to know when to I'm wrong and admit it. I admit it. I did learn a lesson. I haven't completely decided whether or not I will release the fish, but skipjack has at least given me pause to reconsider my beliefs.

But for the fun of it I googled your signature, "MIDWEST AQUATICS RESEARCH". What a surprise! There were two hits! But they both were from this forum. Dang. Maybe your catchy description of what your company does would yield more info. Hey, "Specialists in 'Anachronistic' fishes and 'Parasitic' Aquatic predator Husbandry." didn't return any hits. NONE! Either you are a complete phony, or your company is so insignificant as to not even have a web presence. 5th graders at least have a myspace page.

Since you are unwilling to reveal your supposed expertise, perhaps you should stop saying you're an expert. You fall into the same category as untold thousands of "experts" populating various websites on various subjects, simple to dismiss with a click of a mouse. You say you have revealed your Peter Parker-ish identity to a few of the people on here. With the rest of us normal folk, you have precious little credibility.

Being an Administrator and Moderator on a few sites I'm not going down this road and getting into a pissing match with you. If you want to talk about these things please feel free to PM me. There is no more reason to continue and derail this thread which happens to be an important one that people need to read without Bull ****.
 
Why then is it O.K. for barge's to empty their ballasts and introduce zebra mussles and goby's to lake Erie. Also they stocked steelhead trout in the rivers and they weren't native. That's OK
But my 2 crappies are gonna destroy the rivers and lakes.
