It doesn't matter if you catch it, only that you own it. I'm just trying to help you avoid possible jail time and possibly thousands in fines. I won't turn you in considering i live in a different country plus you seem to want to take good care of the fish but someone else might report you.
 
most natives kept are sunfish, bullhead, bowfin, perch, and minnows, most of which don't require any permit. Pike are on a different level legally due to their popularity as a gamefish
 
my friend had a VERY close call with keeping natives. he had a largemouth bass, which was illegal. His sister fould out the law and called the authoraties to get revenge for a prank and they popped by. the only reason he avoided prosecution was because his bullhead ate the bass, which was maybe an inch or two shorter then the catfish before the authoraties got to his house and they couldn't verify anything. Just trying to help you avoid that sort of thing.
 
Yeah you must make sure what you are doing is Legal, And you have the correct permits for everything. You can risk some serious money and jail time if you are caught doing something illegal. Why not just apply for the permit and make it so your legal if its required in your state.

I don't know where you got your info but It's not illegal to keep game fish in the states. You don't need a permit in all states either. Some states do require a permit to keep native fish and a few prohibit it. But not all states are the same. And the Us fish and wildlife service won't come after you unless you are keeping a US endangered or threatened species or a species on the banned list.

Also it is not illegal to use gamefish as bait in all states. Here in Ohio you can use any fish you want to as bait. As long as it was caught by legal means and meets any size requirements.

I understand that Canada laws may be different. But I don't remember OP saying he was from Canada.

If a permit is required in OP state then I would advise you to get said permit. Since you are posting on public forum.
