beside that, i personal see the paid money as irrelevant right now. The only portant thing is to save the fish. Go to that UPS Freak and Tell them, that you want your fish now and accept no excuses.

This seems like a good way to leave the UPS store in handcuffs.

Im all about saving the life of a fish but as most have pointed out that is the fish have been in a package for two days and the box is damaged they are most likely perished. And since the buyer paid for overnight shipping and the shipper did not ship properly, this shipper is liable for the deaths of the fish....not the buyer.

Also, it is not that I do not care about the welfare of the fish being shipped, but if nothing is done to the shipper by holding them liable then this could cause them to endanger the lives of more fish later on down the line.
 
good point from a legal stand point. maybe the buyer doesn't want to increase the chance of the fish dying.... maybe more concerned with the actual fish sent rather than the money... depends where the priorities lie..... very good point though.
I know it's very frustrating when dealing with live animal, whether as a seller or a buyer, when one party doesn't follow the agreed ground rules

Make a claim, ask for refund from the seller. Call ups everyday and make complains. Email. Just do all you can. But ups probably won't do anything. They have done something like this to me, but a bit different. They ended up taking a $500 package to the wrong address like 5 houses up the street and haven't done anything about it sense. They don't care about their mistakes. Even if the people that handled the package say that they did deliver it to the wrong address, or in your situation. Kill the fish and damage the package.
