As far as innocent until proven guilty that is not always the case say me and you are arrested for a crime we both did not commit I have money and you do not so I make bail and hire a great lawyer and I beat the charge but you can't afford that now you have to sit in jail and fight your case from behind bars months go by and you start to miss your family the courts offer you a plea deal you can go home right now but you have to plead guilty to a lesser charge most people take the plea deal now you have a criminal record for something you didn't do
 
i agree but dont see how that applies we do know the teacher left the phone on the desk, kid got up, opened the phone and the rest is history.

I do think there has been a shift in how good/bad right/wrong is viewed.

I guess its parenting if that were my kid forst thing i would have addressed is why did he touch something that doesnt belong to him, why was he iyt of his chair without permission? I guess these values arent widely taught. Discipline

There is a somewhat similar situation going on in my area where a kid was arrested for collecting and posting nude photos of female students on a public drop box folder.No phone was stolen but the teen was charged with transmission of sexually explicit images by a minor.This guy had posted photos of more than thirty females.

No parent wants to see their kids behind bars i wonder if this kids parents think he did somrthing wrong or was it the girls fault
 
I still blame both but the teacher started it. I'm sure the school has a policy against bringing porn to school...which is what she did. The kid 'stole' her phone...both guilty.

You're a teacher, do you lecture your student with that kind of language/potty mouth? What area/school district are you teaching? Most school districts in my state have issued teachers with iPad, some even have iPad for student to use, so the policies you stated must be out-of-date. My 6th grade daughter can bring her iPhone into her classroom, as long as she turns it off during the class. She can use it during break or recess time. There're several computers in her classroom for students to use. My 4th grade son classroom has iPad for the students to use an hour everyday. Both of their teachers take roll call via iPad.

Plus using electronics as an instructional tool such as iPads is different than say having a phone out and checking social media. Although the district/site may say no electronics, the rules vary from school to school and class to class. But one thing that should be common sense is that not leaving your phone out on your table around kids that more often than not make stupid mistakes. Imho, the teacher was asking for it. No passcode lock or any safeguards in place at all. And please do not get me wrong, the student should definitely face some sort of punishment but like always there is too little repercussions for these idiots.

Exactly, instructional tool one thing, phone another. And not taking a phone away because of "upset parents" is ridiculous.

This is exactly why ALL students bring back signed student contract forms that detail all the rules and consequences in place such as having phone out in class. Plus teachers cannot physically take the phone away therefore trying to confiscate phones is a common issue that admins deal with regularly. Parents can't be upset because they SIGNED the contract at the beginning of the year. Documented = no excuses later.

Funny how you can't tell between a question and a statement. Did I state or did I ask whether you use that kind of language to lecture your students? Funny how district may say no to electronics, but the rules vary from school to school and class to class, yet students need to bring back signed contract. Perhaps, it vary from student to student as well. Some may fed that contract to his dog, some may use it to wipe his dog behind. How can you, a teacher, be so dumb and inconsistent?
