No matter how naive people are, once you accept money for a product you have the responsibility to provide that product or service. It is called "theft by deception" and your law interpretations are poor, at best.

These buyers have every right to retrieve their money. Your thoughts on THIS transaction are flawed. And the blame will be attributed directly to the person that solicited the end buyers........now you know.

i agree. as crappy as the situation is for the OP, at the end of the day the burden of delivering the product falls on him, not the buyers. its the simplest form of a contract. seller offers xx product for $xx. buyer pays. seller cannot provide xx product, so buyer is entitled to a 100% refund. there is no "pre-pay" bullcrap in this situation. that is how it works. you pay, then you get the product. its not you get the product then you pay.

Anything you buy on the internet, you have to PREPAY, they do not send you the product and then ask for the money. You seem quite confused.

you seem confused... i understand the buy before you get product on the internet. what i'm saying is, you should buy after you see the prouct in a picture or in person. if you didnt see anything why would a normal person with common sense purchase a "RARE" fish and not do the homework? did all those that prepaid did not see all the alarming signs of a bad transaction? did all not see all the experts who specialize in Datnioides chime in and say they cant get them or havent seen or heard of a ST that size? if you did not see all that and read up on the thread, but still prepaid, then, YES, i would say it is your fault.

were all of you not warned? and now all of you act like you were not and its a surprise and everyone should feel bad for you and your money. well sorry but i dont. i'm tired of ignorant poeple doing stupid things and blaming others for their mistake.

id he ever once twist your arm, or hold a gun to your head, or threaten you if you did not purchas? i'm sure he didnt. he was a little pushy at trying to get the money but never once used any other means of force. so i would ssay that if you prepaid, then you "made" the decision to purchase not him. its not like you puklled money out of your pocket and handed it to. i'm sure you had to paypal. so before you paypal it asked again how manytimes before you click confirm? so you have how many chances to think about it and not buy. :screwy:

i'm sorry to those i may offended but its not right to always blame the seller. cry if you want, hate me if you want, but ryan was upfront with me and honest. so i took my precautions and said hmmm...i'll pay the extra $100-$200 or whatever the inflation price will be oncce they are in the states and wait rather then put my money up front and not get it back.

I agree it falls on the seller to provide the product promised, whether or not their supplier provides the seller with what they promise is another story.


Yanker, you can't just yell "SCAM". Your favorite vendor made the SAME mistake. I doubt you'd call him a scammer. Hopefully everything works out for the best.
 
Rclark has put himself in this situation and it's entirely up to him to refund people their money back as he promised. Hopefully there were not too many people who prepaid. I know he had an greement with the vendor too that they would refund his money if they weren't ST's. I don't know how much that is worth but hopefully he had something in writing with them.

your understanding of business law is very skewed. despite what you "think/feel" about what is wrong and right, it doesnt work that way in the real world. should this turn into a legal battle, the OP would have to refund everybody theyre money. simple as that.

and your statement about not putting a gun to anybody's head. are you serious? :screwy: dumbest crap i ever heard. he offered a product for sale, he solicited the buyers. you need a reality check
