I can see it being fraud if you are selling an item claiming it to be what is in the picture when it is in fact not.

But to say it is fraud using a google image as a general species identifier on your website, without any claims of this being the exact fish you will recieve. BS

It's still fraud because the person who stole the pics doesn't have legal rights to copyright it and isn't giving him any credit for the pic. With out claims of it being the actual fish for sale can cause a problem also. When the buyer sees the pic that's what they are going to be expecting but once they actually the fish and they aren't the same it can cause problems for the seller.

Using an image as a species identifier would be fine if you were to state that and supply a link to the authors original source upon permission. The main issue here is the act of using the image belonging to the original author without their permission or license. It is plain and simple image theft and illegal. It is no different to making a commercial and using a song without the artists permission or license. Just because you can find an image using a search engine like Google doesn't mean you can do what ever you like with it.
 
It's a picture someone found of a certain species of fish to show as an example. Unless they were showing them saying " This is the fish I am selling you" and they show your picture I wouldn't be that upset about it. But this age of people get all upset because someone used their picture for something. I understand your mad, and you have a right to be, I'm just saying IMO it wouldn't have ME that upset and I honestly wouldn't care that much. I would maybe call the aquarium and ask them about it but, yeahhhhhh, wouldn't get that mad about it.

Petty? You obviously have not had too many of your images used illegally to be making a statement like that? As a photographer that sells licenses, I can tell you from first hand experience that image theft happens constantly. Don't get me wrong. I couldn't care less about Joe Blo downloading one of my images for personal use on their pc or sharing it on a forum etc but any image stolen and used without my permission or license for any financial gain is a loss of my rightful income and also an insult to my honest clients who have legitimate licenses. Thankfully the law has no problem seeing this and as such most cases are very easy to deal with. I have settled several cases in the last couple of years with a few overseas cases still to be sorted. A couple of which who are in for a rude awakening once my solicitor has the final identification details sorted. The moral is simple really. If it is not your image, don't use it without license or at least written permission. If you do, don't be surprised when one day the original author of the image sues. ;)

I would be mad as all hell. Even if they just used the pic they could have given him his credit for the pic and said they were just examples. I believe him being soul owner of the pic he is entitled to some type of compensation just off of copy right

Your correct, I haven't had any images stolen. Mine aren't good enough.

But I just recently had an invention of mine stolen, and copied to exact specifications and being sold on ebay with the same exact listing title as me.

I designed these repair plates and have been selling them many years.

So I do in fact know the feeling. As I am losing 10's of thousands of dollars over this deal. Because I didn't get it patented.

That could be why I see this as petty. Because look at all I've lost.

This is how i see at no point in that post is there a message saying the picture is of the fish or refer to the display picture on the website as this is the fish, the picture is just there to make the site look good. Yes it wrong but is it making him dishonest no. this is the point i was trying to make its just being used to show the type of fish not the exact fish and no where on the page does it mention the picture is the actually fish for sale.

hence calling him dishonest i feel is in correct. He stole a picture without asking you if anything call him a picture thief but calling a whole aquarium dishonest for one little thing like this is over board especially when theres nothing evening pointing at the picture saying they are the fish for sale.

And if people are really so defensive of there pictures there is an easy solution, dont post the picture on free sites where something like this could occur, theres always going to be someone stealing your pictures. Its the Internet... look at the movies they lose millions of dollars and there is very little that can be done. no offense but its a pretty basic simple picture also its not as if he stole a picture of the monalisa painting and tried to sell it. its just a normal picture shot off a camera, no art no nothing so he didn't even steal anything special just an iphone picture from the look of it, not that it makes it right but there are much better pictures of frontosa on the net so if he was trying to scam people he could of used a more decent picture.
 
I would hope if your spending good money on fish your willing to look at the fish in person... if your spending so much money on fish and not willing to look at the fish in depth its a 50.50 fault imo I dont know how someone can buy a fish just from a picture?!?!?

I dont know maybe because I know the owner and know his a nice guy and his intent was not to rip people off, his actually one of the best LFS owners down here and I know pretty well all that has happend is his typed the name of the fish into google taken the first decent picture that came up to use which is illegal yes but come on grow up. Its very rare for fish worth 2000$ to just sell down here be smashed in a boxed and sent. People normally look first or request pictures, anyways imma stop posting here, everyones going to look at it different, this thread just wasn't required.

For some of us, looking at the fish in person is not an option.
