I put a fountain in my ornamental pond, that sprayed out towards the edges. Our local patrolling Heron didn't like it.
We also have a couple of Osprey that come around from time to time. But the little pond is too shallow and close to the house for them.
I saw one nail a 5lb trout in the big pond. It had a really hard time gaining enough altitude to clear the high banks. It skimmed the bank by inches and just barely got enough air to miss the plants in the field.
Very cool to watch, especially the initial dive, which is straight down!

Im setting up a motion sensor sprinkler head now...He didnt get a fish, but he got shot in the neck, tried to fly, so i put him out of his misery...he will be a scarecrow for his kind for a week or so....till he smells

The chilies idea wouldn't work.
Birds are unable to/barely sense the "hotness" of the peppers; only mammals are majorly affected by them.
Also, shooting the heron is just plain illegal, as mentioned by others; consider adding plants in and around the pond to deter the bird.
