I pull a gun that you didnt know about, u tell me not to when I pull it and I fire once killing,the guy. Should u be charged with murder? You didnt know I was gonna do it. U didnt know about the gun.

If both of you get in a fight, then one (you) pull out the gun and shoot, most likely both will be charged with murder, but only you will be tried for murder. Being charged is different from being tried, and being convict...

whos to say the other two werent telling him to shoot? There is more to the story then anyone knows. He could have been handed the gun and told to shoot them to get them off their tail....They all deserve to be charged and tried for murder. Give them life and let them rot.

We don't know who actually have/own/bring the gun, who actually pull the gun to rob. We only know who was accused of pulling the trigger. It's not a clear case like your example. I wish everyone is an upstanding citizen like you in your example, who admits to bring a gun without other person's knowledge, and admits to shoot, but in real world, all three involved will get charged equally.

Hang out and getting into a brawl is a much different then if we were going someplace with the intent to commit a crime. But if we are both fighting the same person and he is killed, then yes likely I would need to be charged with murder. Because of my actions this man is dead, regardless if I pulled the trigger or not.

Luckily I am a decent judge of character and would not find myself hanging out with some gutless puke that would pull a gun in a fist fight.
