Liable?

Recently, I sold a large golden arowana for a few thousand dollars. It was swimming fine and eating fine at my place. When the new owner brought it and place it in his tank, the fish went belly up and died the next day.

Am I liable for the death of the fish, and have to refund the money like the buyer suggested?

if it was a 10 dollar fish ok

but the buyer should have known what he was getting himself into

you cant just go around killing mad expensive fish and demanding your money back, one could go out of business that way
 
Depends on the agreement. Guaranteed live delivery? Need a pic of the dead fish in the unopened bag? or was it guaranteed for a week after delivery?

Most shippers, at the most, guarantee live delivery. After the fish is removed from the shipping water it's anyone guess what happens.

If you said "I will guarantee the fish will live for a day after delivery" then your responsible for the death.

If you guarantee "live delivery" not your responsibility.

If you didn't guarantee anything then it's really not your responsibility, bad decision on the buyers part to agree to this.

I am guessing that you are not going to be liable, even if you offered a live arrival guarantee. He sounds as if he were not ready for the fish's introduction and simply dumped it into his tank.

Arowana's do not just die like that. He likely did something wrong.

Even if the fish did arrive sickly or far too stressed out from the shipment, he should have taken pictures before introducing it to his tank. He bit the bullet if that was the case.

Good points,I'm guessing that the buyer must have observed the fish in it's tank in your home before deciding that he wanted it.If that is the case then he already knew that the fish was in good condition and if it died the next day after purchase then there must have been something fishy with his tank water....Maybe it was one of those overcrowded JDM tanks but with inadequate filtration.:ROFL:
 
Then you are fine. Tell him to take it to small claims court so a judge can throw it out the window.
