Liable?

Unless you explicitly provided some type of guarantee, items sold by private individuals are considered to be sold as-is. The only way you would be responsible is if you misrepresented the condition of the fish. I would feel bad about it, but the person selling has no control over what happens to the fish once it leaves his hands. I would not give him any money back, because that could be used against you to make it look like you accepted responsibility for the fish dying should he decide to come after you for the whole amount.
 
Fish die, even expensive ones.
As the purchased or such said expensive fish you should be prepared for such an event. There is always the what if factor.

As the seller you can NOT be held liable for such said expensive fish once it leaves your tank. Unless you damaged it removing it from the tank. There are too many variables beyond your control which could of led to the fishes demise. A clean water sample would prove nothing.

I myself would NEVER spend that kind of crazy money on any fish. If it's that rare, it's too rare for me.
 
The fish died of PH shock, my water is neutral and his water is 5 (he just threw the fish in after 30mins)

here is my way of looking at it: if you sold someone a car that was in good working condition, and then they drove into a tree on the way home because they were texting-while-driving, do you owe them anything?

how the jackass buyer could just toss an expensive fish into his tank w/o checking the basics - - Ph, hardness, etc. - - is beyond me. I do that even when I buy a $5 fish at the LFS

no refunds for piscicides . . .
 
1st - PetSmart would never sell an arowana
2nd - It's the buyers responsibility, just like when you buy saltwater fish from any store. The store can not control the water conditions in the buyers tank. Same concept here. PH of 5 would kill goldfish in 16 hours (trust me I know...lol) let alone a beautiful expensive arowana. Give him $100 so he can go buy a small silver aro so you don't feel bad!
