He should not take it and sue instead

I definitely agree he shouldn't take the same job as before... why would you want to then go back and support a company that initially screwed you, and is only hiring you back because of public pressure...

Honestly, once a client / company even attempts to screw me over in any way, that is the last time i do business with them... simple as that...

What could he sue for though? He broke company policy in doing it and they even said not too. I agree he shouldn't have have been punished for trying to help someone but I can't see anyway he could sue them.

He abandoned his post. He should call 911...

W O W ! I'm shocked.

Glad his job was offered back though

Wrongful termination. I bet this guy has been flooded with lawyer phone calls since this. Especially after they offered his job back - which shows they were wrong.

Sue the dam company/ some policies need changing anyways. He should get 6 figures and his job back if he still wants it.

I think he should. Serves them right for trying to punish someone for saving someone else's life.
He cant. They offered him his job back and he violated the rules.

Look its a bad situation. BUT, the town choose to have certain areas that are covered by lifeguards and areas with "swim at your own risk". That person chose to swim in one of the latter areas. The company did what they needed to to protect themselves. Imagine what would have happened if a person drowned in the area his company is under contract to protect while he was in an area that he was not supposed to be in.

It sucks and its a bad situation. But our society is so sue happy, the company just wants to cover their own butts.

He was offered his job back, take it. Your not gonna win a lawsuit because the LIFEGUARD was in the wrong. He left a post heis employer was under contract to protect.

Hmmm, This is an interesting one. He is a lifeguard, and he did help someone that was drowning. Thats what he is supposed to do. BUT, he is hired by a company to patrol a designated area. That area is considered safe because there is a lifeguard there. As much as I hate to agree with J, I actually do for once. How many other people were put at risk when he left his area that he was trusted to patrol to save someone who chose to swim in a posted dangerous area? Obviously people wont hesitate to sue (there are perfect examples in this thread), so what would have happened if someone had drowned in his designated area while he was elsewhere? The company's a** would be in a sling. I'm sure they have very strict rules about not leaving your post. I would imagine they can't even leave to use the bathroom. And for good reason. That's not wrongful termination. He's a liability. If you can't follow rules, you shouldn't have a job where other people's lives are in your hands.

Edit: haha you beat me to it
